Terms of Service

These terms govern your use of BrandMaestro AI (“the service”), operated by BAND AI (“we”, “us”). By creating an account or using the service, you agree to them. If you use the service for a business, you confirm you may accept these terms on its behalf.

1. The service

BrandMaestro AI learns a brand's voice from documents you upload. It researches, writes and checks marketing content in that voice. Its optional YouTube Studio turns approved scripts into videos and uploads them to a YouTube channel you connect. Features may change, and some depend on third-party services being available.

2. Your account

• Give accurate information and keep your password secure.
• You are responsible for activity under your account. Tell us promptly if you believe it has been accessed without permission.
• You must be at least 16, and old enough to form a binding contract where you live.

3. Your content

• You keep ownership of the documents, images and other material you upload, and of the content generated for you.
• You give us permission to store, process and transmit that material only as needed to provide the service to you. This includes sending it to the service providers listed in the Privacy Policy.
• You must have the rights to everything you upload. In particular, only upload a face photo or other likeness if it is:
  • AI-generated;
  • an illustration you may use; or
  • a real person who has given consent for this use.

4. AI-generated output

• Content, images, voices and videos are produced by AI models and can be inaccurate, incomplete or unsuitable. Review everything before you publish it.
• You are responsible for what you publish and how you use it, including making sure claims are true and advertising rules are followed.
• Do not use the service to impersonate real people, mislead people about who is speaking, or create deceptive, defamatory or harmful material.

5. YouTube

• YouTube Studio uses YouTube API Services. By connecting a YouTube channel you agree to be bound by the YouTube Terms of Service, and you acknowledge the Google Privacy Policy.
• You must follow YouTube's policies, including its Community Guidelines, its rules on altered or synthetic content, and its monetization policies. Every upload is marked as containing AI-generated content.
• Videos are uploaded as private and published only when you choose. YouTube may restrict, lock, remove or refuse to monetize videos under its own rules, and we do not control those decisions.
• You can disconnect your channel at any time. BrandMaestro AI is not affiliated with or endorsed by YouTube or Google.

6. Acceptable use

You agree not to:

• use the service for anything unlawful, infringing, fraudulent, harassing or hateful;
• upload material you do not have the rights to, or personal data you are not allowed to share;
• generate spam, or mass-produce misleading content;
• try to access other businesses' data, get around security or usage limits, or disrupt the service;
• reverse engineer the service, or resell it without our written permission.

7. Third-party services

The service relies on third parties, including Google Cloud, YouTube and AI model providers. Their availability, pricing and terms are outside our control. We are not responsible for their acts or omissions.

8. Suspension and termination

• You may stop using the service at any time, and ask us to delete your account as described in the Privacy Policy.
• We may suspend or end your access if you break these terms, if your use creates risk or legal exposure for us or others, or if we stop offering the service. Where reasonable, we will give notice first.

9. Disclaimers

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We do not promise the service will be uninterrupted or error-free, or that generated content will meet your needs.

10. Limitation of liability

To the extent the law allows:

• We are not liable for indirect, incidental, special, consequential or punitive damages.
• We are not liable for lost profits, revenue, data or goodwill.
• We are not liable for decisions YouTube or other platforms make about your content.
• Our total liability for any claim relating to the service is limited to the amount you paid us for it in the 12 months before the claim.

Nothing in these terms limits liability that cannot be limited by law.

11. Indemnity

You agree to cover claims, losses and costs that arise from content you upload or publish, or from your breach of these terms or of YouTube's terms.

12. Changes to these terms

We may update these terms. The effective date above shows when they last changed. We will tell you in the app before a significant change takes effect. Continuing to use the service after that means you accept the updated terms.
